    Sadly, the people who author bills like this usually have no idea what they’re talking about. Like the people who vote for red light cameras. They get surprised when they get ticketed by one. When they write or vote for laws like this, they never think how it applies to them. They think only about how it applies to “those people”, until it comes around and bites them in the butt.

          As a website designer, we get a bag of money to “make it look good” because no one else can. Grow up. The image was purchased under a licensing agreement from one of several services like istockphoto, gettyimages, etc. The licensing agreements do not require attribution. The user may do anything they want with the image so long as they don’t create retail items (like calendars, books or t-shirts). If you want to fight SOPA do it on the merits of your argument. Stop being an idiot.

            What do you mean “Grow up”? Why are you offended by the statement? No where in his comment did he put down website designers. He said that Lamar Smith had nothing to do with the design himself, he just hired someone to do it for him and therefore doesn’t realize the infringement. So with that in mind, you are the one taking offense where none was given and are therefore acting like a misunderstanding child getting hurt over nothing. Grow up. And BTW, doesn’t matter if he knew about the infringement or not the guy is still a total f*ckstick and needs to be voted out.

          Doesn’t matter. According to SOPA it’s the site’s owner/operator who’s responsible for the content, no matter who put it there. (this is an example why Youtube could lose a lot with these bills)

    • The image was released under creative commons license, which states (in part) that an image may be used so long as the creator of the image is credited.

      The image is classified as a free-source document to be used by anyone at will under the authors own copyright terms. One of these respective terms is that by using the image the user agrees to credit the author. By not crediting the author mr. Smith here commited copyright infrigment. Perhaps unintended yes, but under SOPA and PIPA’s unforgiveness, his site would already be black listed and possibly blocked even before he could amend his mistake.

      Actually, it’s copyright infringement if he used the image without the owner’s permission, regardless of whether he credited the person or not. What are the odds that this guy asked the photographer if he could use his photo though? So ultimately, he could still in fact be in violation of copyright.

      Why do you think a lot of tv shows make up fake brands for shows, food, drinks, and so on? If they use Pepsi cans and don’t “credit” it, it means they didn’t pay for the logo to be used. It’s very odd.
      But the photographer can take him to court if SOPA passes because the congressman did not pay the photographer to use his picture.

      Which is what the congressman is using SOPA for, so people will get their “credit”.

        Under the Berne Convention, copyrights for creative works do not have to be asserted or declared, as they are automatically in force at creation: an author need not “register” or “apply for” a copyright in countries adhering to the Berne Convention. As of September 2008, there are 164 countries that are parties to the Berne Convention.

        TL;DR: You’re wrong. Copyrights are created automatically with the creation of creative works.

        • Regardless of whether it was copyrighted or not… He posted or used an image that wasn’t his for the BG of his Political website… Secondly, if he didn’t like the image he wouldn’t have ‘shared’ it to the rest of us… So isn’t he technically doing the same thing we do when we use or share an image on any other social site? That’s basically what the bill is taking away from us… So are you saying that it’s okay for him to do it just because he is some Troll in the Senate and we aren’t because we aren’t a Political Troll with money to throw around?

        Not at all. What is depends on is if the author gave permission for it to be used in such a way. If they said it was okay and told them credit wasn’t necessary, then it’s fine.

        A lot of stock agencies and sites don’t require credit be given, and based on the nature of the photo, it easily could be from a stock site or agency.

And i’m sure this guy has permission to use that photo. He would have to be an idiot not to get permission first, especially since he is a copyright protection freak. This politician’s website is not in violation of any US copyright law (at least not as far as you can tell, you don’t know if he got permission from the rights holder, he probably did), and the creator of this image is actually in more violation than him because they probably did NOT get permission to use it, and they are also slandering the politicians name.

      It was a stock photo, and according to the article this was posted in, the creators of the image claim that neither Lamar nor any of his agency ever contacted them getting permission for use. And that, my friend, is copyright.

      It is if they didn’t pay for the rights to use it. There’s two scenarios: The web designer purchased the rights as part of a package and did not credit the source of the package in the web footer or the image’s alt tab, which is standard practice and indicates it’s an amateur web designer. Or, the web designer did not purchase the rights from a package or from the photographer, and didn’t give a flying fig that he didn’t pay for or credit the original artist for the work – hence, piracy.

      Actually, with SOPA, it is. If the artist wanted to, he could take this to court and win since he was not credited and it would count as pirating since there probably was no written documentation stating that he could use it. He would ultimately lose that case and be fined or probably even charged.

          If it passed, he could try to do that. However there is a loophole that lets out folks like legislators from minor trials such as these and thus suffer no consequences from it.

          Therefore, his only recourse would be to press litigation against the domain holder and blackout the website.

      Actually it will cost more, due to many hosts not being able to enforce the law and being shut down. The ones that do, will have to employ more folks to police this for the MPAA, RIAA, EA, Vendevi, and Activision.

      It is the same pic but only the top half is used as the background. It’s been cropped. The original was likely a large resolution file and instead of using the full pic only a section was pulled out because the picture itself isn’t of interest. It’s the motif of colors to set atmosphere in the background that was ultimately desired.

This act will give the government power to censor anything they see fit. The beauty of the internet is that it allows for complete freedom and access to instantaneous information.     I went to a Lamar Smith website (a .house.gov one). Same guy – as far as I can tell; his toupee parts on the other side – but it didn’t look like that.

      We all understand that we need to teach him but the real question is how. If we are to write him a letter we need to have a zip code from his area and use it on the letter, which is probably illeagle and will make him even more invincible. Ive looked everywhere and there are only 2 things we can do to affect him.1 is the previously mentioned, 2 is a physical protest. If we are to do the second one we will need to know where the supreme court is located, what date everybody leaves to go there, and who will lead it.

    I think the question is this: was the picture he used copyrighted in the first place? Remember that there is some paperwork that must be submitted in order to copyright something. It is entirely possible that the picture was not copyrighted at all. I don’t support the guy, I’m just saying that he might not be a pirate.

Don’t we, as a republic, vote many of our officials in? If we’re foolish enough to vote in liars, adulterers, movie stars, wrestlers, comedians and TWO Bush’s… doesn’t that show a bit of a bad judge of character? And when it seems like the most important qualities in a politian are party, religion, sexuality (may I add that race and gender are close behind)… it seems that general intelligence and dependability aren’t very important at all.     The issue is not that he didn’t give the photographer credit for the image the issue iis did he pay for the right to use the image! I’ve never seen credit given for any photo I’ve ever seen in a restaurant, on a menu or at any drive thru but I can guarantee you they paid for the right to use the images. If he paid for the right to use the image then he is in the clear – whether he gave the photographer credit or not. By the way…. I am a professional photographer and I am totally fine with the fact that he didn’t give credit as long as he paid for the right to use the image. I sell the rights to use my images all the time & I rarely ever get credit for them. I am totally fine with that.

      The problem is that PIPA and SOPA aren’t really about policing the internet, they would fundamentally destroy the internet. Imagine if you turned on your computer tomorrow and memebase no longer existed, or wikipedia, or google, or facebook. Or any social networking site, photo sharing site, video sharing site, search engine, or any other website that could potentially promote or harbor “pirated materials”. Sites based out of the US that violate these bills would be shut down and sites outside of the US would be unavailable to US residence.

      If the bill doesn’t get shot down, if people are willing to be controlled and censored then other countries will try to pass similar legislation. Eventually the internet will die and we will be back to an age before easily and freely shared information.

      And why stop there, these are the same people who wanted VHS technology banned due to it’s potential use for piracy. Imagine if writeable disks were no longer availalbe, no flash drives or external media because they could be used to pirate copywrited materials.

      This may sound extreme, but this is what people like Lamar Smith are working towards. Eventually they’ll even try to censor what people say and do. It’s not policing if they are taking rights away from people. It’s not policing to punish people for what they have the potential to do.

    I don’t know if anyone noticed but we are fast, approaching, and becoming a fascist state. Think about it, the lobbyist control congress with all the money they give. The people in congress go in with not much and come out millionaires. We need to stop all the money from lobbyist, and special interest, and put time limits on them. We’re not living in what should be a ‘modern’ age where the law applies to everyone (and even that concept is ancient, going as far back as the 10th century), but they think the law and everything else applies only to the non-elite, while the guys at the top can literally do as they please with you, your money, and everything you have.
